VOXANT respects Your privacy and will use commercially reasonable efforts to protect any information that identifies You, would enable someone to contact You, or that describes Your relationship with VOXANT (collectively, “Personal Information”) from unauthorized access and use. The following policies describe how we gather and use Your Personal Information. THIS POLICY MAY BE REVISED OR UPDATED BY US AT ANY TIME AND WILL BE EFFECTIVE WHEN SUCH CHANGES ARE POSTED.  YOUR CONTINUED USE THEREAFTER WILL CONSTITUTE ACCEPTANCE OF, AND AGREEMENT TO BE BOUND BY, THOSE CHANGES

Personal Information Received
VOXANT and its Content owners and advertisers (collectively, "Affiliates") collect information and data about licensees and users of the Player, Voxant websites (including www.thenewsroom.com), and related services (collectively, the “Service”), including data about the persons, entities and systems to which Content is transferred. “Content” includes any and all images, designs, graphics, logos, marks, audio files, video, data, material and information posted, linked to or otherwise made available by VOXANT on or through the Service. We may obtain Personal Information via direct contact with You or users of your site or services (“Users”) or from our Affiliates based on Your or Your Users’ contact with them or receipt of their services. The information received may include contact details, registration and payment information, support and usage history and data about Your interests, preferences and use of Content and the Service. Information may also be obtained on You and Your Users as a result of authentication or identity checks. By providing any personally identifiable information to VOXANT, all users, including, without limitation, users in Canada and the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the collection, storage, and processing of such information in the United States of America.

Information We Collect via Services
If You are a registered user of the VOXANT Player (the “Player”) or the Service, VOXANT gathers information about Your use of the Player and the Service, including generic information about the types of Content accessed, the times and volume of use of the Service and Traffic Data. "Traffic Data" includes logs, details of networks, data and systems accessed, details of the sender and recipients of Content, times and location of log-on or access, duration of sessions, click-stream and similar usage or system data. Traffic Data may sometimes be traceable or related to both companies and individuals.

Use of Your Information
VOXANT collects and uses information about You, and use of the Service by You and Your Users, (a) to administer, support, improve and obtain feedback on the Service for us and our Affiliates, (b) to detect and prevent violations, breach or misuse of the VOXANT Membership Agreement, (c) to detect faults or breach of network or application security, (d) to earn revenue from our Affiliates, and (e) to support and promote our Affiliates. We also use this information to assess what VOXANT products and services may be of interest to our customers and to personalize our Service. If You register to use the Service, we may contact You to obtain feedback on the Service and any improvements You might recommend and any such recommendations shall become our property. VOXANT may regularly contact You via email in order to provide financial account updates. VOXANT may disclose information we collect from You if required to do so by law or in the good-faith belief that disclosure is necessary (a) to obey the law or comply with legal process served on us or our Affiliates; (b) to protect and defend our rights or property or the rights or property of others; or (c) to act in an emergency to protect the personal safety of members of the public. 

Storage of Data
VOXANT may store Your or Your Users’ information in its databases or in the databases of our Affiliates. The information may be retained and used by VOXANT or its Affiliates for an extended period to permit us to resolve problems, provide improved or additional services and to comply with internal audit and data retention policies. This means we and our Affiliates may retain Your or Your Users information after You or a User ceases to use the Service and for an extended period after the Traffic Data was generated.

Transfer of Information to Affiliates
Except for transfers to our Affiliates, VOXANT does not sell or rent Your Personal Information to non-affiliated third parties. Use by us or our Affiliates may include confirmation or proof of the use and distribution of our Service in order to obtain payment or credit from our Affiliates. Such recipients may then match our information with the data they otherwise have for this or other purposes. We are not in a position to notify You when such transfers may occur or to condition its use by such recipients. If we sell all or a part of our business to another company, Your Personal Information may be transferred to the buyer for use in its business.

Affiliate Web Sites
A "cookie" is a piece of software sent to a computer to enable the collection of user information about how web sites and services are being used. You can turn off the ability to receive cookies by adjusting the browser in Your computer. Where advertising is served onto our web sites or where Your selection of certain Content may redirect You to the web sites of our Affiliates, there may be cookies used to collect technical information and generic usage information about You. Any such advertisers, licensors or Affiliates will not be able to relate this information to You as an individual without Your consent.

International Access to Information
Because the Service is available internationally, Personal Information may be made available in countries which do not have data protection laws or which have laws which provide less protection than in the U.S. We cannot ensure that Your Personal Information will be protected by any such recipients in the same manner as protected by us.

Collection of information from children
VOXANT does not direct any of our content specifically to children.  From the Service we do not knowingly collect or use information from children under thirteen (13) without obtaining verifiable consent from their parents or a guardian.  If we learn that a user is under 13 years of age, we will promptly delete any information we have collected about that user.  If you are under the age of 13, please do not send us any information about yourself.

Your California Privacy Rights
As provided by California Civil Code Section 1798.83, a California resident who has provided Personal Information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of Personal Information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of Personal Information that were disclosed.

However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer’s Personal Information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of Personal Information and providing a cost free means to exercise that right.

As stated in this Privacy Policy, we do not share information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure -- typically by opting in to receive information from a third party that is participating in some activity describes on one of our sites. If you do ask us to share your information with a third party for its marketing purposes, we will only share information in connection with that specific activity, as we do not share information with any third party on a continual basis. To prevent disclosure of your Personal Information for use in direct marketing by a third party, do not opt in to such use when you provide personally identifiable information on one of our sites. Please note that whenever you opt in to receive future communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. You should always review the privacy policy of any party that collects your information to determine how that entity will handle your information.

California customers may request further information about our compliance with this law by e-mailing CaliforniaPrivacy@thenewsroom.com. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

Contact with Help Desks
Calls and emails to VOXANT and our Affiliates' help desks and contact persons may be recorded and retained for quality control, regulatory and monitoring purposes.
